TERMS AND CONDITIONS OF USE

Ι. Brief Introduction

These terms of use govern the rights and obligations related to the use of the website https://www.librebay.gr, as well as all elements included therein, with the purpose of providing information about the Company, its products and services, and facilitating reservations for the leisure sailing yacht managed by the Company.

The use of the Website, including simple browsing, is subject to these terms of use.

Use of the Website implies the unconditional acceptance of the Terms of Use, which the Visitor is invited to read carefully.

Acceptance of the Terms of Use occurs upon the Visitor’s entry and navigation on the Website. This acceptance constitutes the Visitor’s explicit, unconditional, and irrevocable agreement to comply with the Terms of Use.

In case the Visitor disagrees with any of the terms, they must leave/exit and avoid browsing the Website, notifying, if they so wish, the administrator accordingly.

The Company reserves the right to unilaterally amend/modify the terms of use in writing without justification.

The Company does not represent or warrant the completeness, accuracy, reliability, availability, or security of the Website. The Visitor assumes all risk associated with any use of the Website and its content.

The Company bears no responsibility for any type of damage (direct, consequential, etc.) related to the use of this Website. The Company does not guarantee that any other website or the servers through which such websites are made available are free of viruses or other harmful components. The user explicitly and unreservedly accepts that no claim may be made for compensation of any damage arising or that may arise due to the aforementioned reasons, with the cost being borne in any case exclusively by the Visitor.

The Company reserves the right to modify, remove, or add parts of or the entire Website at any time without prior notice, unless otherwise stated in these Terms of Use.

The Company bears no responsibility for any temporary or permanent malfunction.

The Website includes hyperlinks to websites that are not under the control of the Company. The presence of these hyperlinks on the Website does not constitute and should not be interpreted as endorsement or approval by the Company of the respective websites and/or their content. The Company shall not be held liable for any damage arising or that may arise from the use of such websites.

 

ΙΙ. Legal Capacity – Adult users

This Website is intended exclusively for adults. By accepting these Terms of Use, the Visitor declares that they possess legal capacity and are over 18 years of age, or otherwise that they have obtained the necessary consent from their legal guardians, who shall be held responsible for any actions taken by the individuals under their care in relation to the Website. 

 

ΙΙΙ. Personal data protection – privacy policy – Cookies Policy

The Company implements a Privacy and Personal Data Protection Policy, as well as a Cookie Policy (see relevant sections).

1. Booking – payment policy
   You can make a booking either (a) through our website at www.librebay.gr, or (b) via our email address at [email protected].

We always confirm your booking via email.

When making a reservation for the yacht managed by our Company, a valid credit card is required as a guarantee to confirm the booking. The Visitor is required, upon arrival, to present the credit card used for the booking, along with identification documents, such as an ID card, passport, etc. In all other respects, the applicable payment instructions provided to the Visitor during the booking process shall apply (including but not limited to, the prohibition of bringing animals on board, the requirement to store footwear in a designated area, the prohibition of diving during departure/when leaving port, etc.). The prices listed on our website are in euros (including the applicable VAT). It is clarified that all payments to the Company must be made exclusively in the local currency (EUR). Any reference to other currencies during the booking process is made for informational purposes only.

 

1. Cancellation policy

In the event that the port authorities issue a sailing ban due to adverse weather conditions, or if the captain of the yacht deems it impossible to depart due to adverse weather, mechanical failure, or any other reason attributable to our responsibility, the cruise will be canceled and the full amount already paid by the visitor shall be refunded, provided that it is not possible to reschedule the cruise for another date due to unavailability of the yacht or the customer being unavailable on alternative dates.

In case of cancellation by the visitor up to 72 hours prior to the scheduled cruise date, a full refund will be provided.

The Company reserves the right to cancel or modify a reservation if it is proven that the Visitor used an invalid credit card or a card that is not approved for use, or if the card use is a result of fraud, or if the reservation contains or is the result of an error or oversight.

1. User responsibility

The Visitor of the Website must comply with the applicable legislative and regulatory provisions and refrain from any illegal or abusive use of the content and services of the Company’s Website, as well as from any act that could infringe any right or legal interest of the Company or a third party.

The Visitor must immediately inform the Company of any use of the Website that violates these Terms of Use and/or applicable law.

The Visitor undertakes to provide and maintain suitable and updated equipment required for accessing and using the Website and its content, including software.

VII. Intellectual property rights (copyright)

All content on this website (except where expressly stated otherwise), including but not limited to texts, images, photographs, and videos, is the intellectual property of the company “STAFYLARAKIS ELEFTHERIOS & STEFANOUDAKI CHRYSANTHI L.P.” or the respective rights holders, and is used by the aforementioned company under explicit authorization from the rights holders or their agents, and is protected by applicable national, EU, and international law. “STAFYLARAKIS ELEFTHERIOS & STEFANOUDAKI CHRYSANTHI L.P.” retains all intellectual property rights regarding the content and any copies created based on it.

The visitor/user of the website acknowledges and accepts that all ownership rights, trademarks, and other intellectual property rights related to the aforementioned company or associated with it, belong to the above-mentioned company or its partners, as applicable. Furthermore, the visitor/user of the website acknowledges and accepts that it is prohibited to use, reproduce, modify, or distribute the texts, images, photographs, videos, etc., or any part thereof in any way. The content is subject to change without notice at the discretion of the above-mentioned company. 

VIII. Governing law and miscellaneous terms

The above terms and conditions of use of the website, as well as any amendments or changes to said terms and conditions, are governed by national law, EU law, and relevant international treaties. Any provision of the above terms found to be in conflict with the aforementioned legal framework or becomes invalid shall automatically cease to apply and be removed from this document, without in any case affecting the validity of the remaining terms. This constitutes the entire agreement between the administrator of this website and the customer/visitor/user of its pages and services and binds only these parties. No amendment/modification of these terms shall be considered or become part of this agreement unless it is made in writing and incorporated into it. It is expressly agreed that any disputes arising from the application of these terms and the general use of this website by the visitor or user, if not resolved amicably, shall be governed by Greek law and shall be subject to the jurisdiction of the Courts of Chania. 

The Company wishes and seeks for any disputes arising from the use and/or interpretation and application of these terms of use to be resolved out of court. Therefore, in the event that the Visitor identifies any incorrect element or information forming part of the website’s content, they are requested to immediately notify the administrator at [email protected].
